DESCRIPTION/BACKGROUND:

Section 2.16.1.B(8)(g) of the Land Development Code (LDC) states a County Municipal Services Benefit Unit (MSBU) shall be established for the maintenance of the improvements created by this division prior to final approval and recordation. A waiver to this provision may only be granted by the Board upon review and recommendation by the Development Review Committee (DRC).

The Agricultural Lot Split is located in the northeast portion of the county containing six lots on approximately 114.97 acres. The LDC permits 10 lots of 10 acres each for an Agricultural Lot Split under Section 2.16.1.

The applicant requests to allow an easement agreement that stipulates maintenance. DRC reviewed the request by the applicant, and after discussion acted on November 18, 2024 to recommend approval by the Board, ensuring the covenants stated access via the common easement would not be maintained by Marion County (See Note 9F of the covenants).

Recommended action

Motion to approve the Agricultural Lot Split without the creation of a MSBU subject to providing the appropriate documentation that the property owners will provide maintenance.
