DESCRIPTION/BACKGROUND:
Land Development Code (LDC) 2.16.1.B(8)(g) Division of Land requires a County Municipal Services Benefit Unit (MSBU) shall be established for the maintenance of the improvements created by this division prior to final approval and recordation. A waiver to this provision may only be granted by the Board of County Commissioners upon review and recommendation by the Development Review Committee (DRC).
This agricultural lot split is in the northwest portion of the County containing 6 lots totaling 62.32 acres. The LDC permits 10 lots of 10 acres each for an Agricultural Lot Split under Section 2.16.1.
DRC action on March 30, 2026 was a conditional recommendation of approval for the waiver request as note 8 on the face of the Agricultural Lot Split specifies that Marion County has no obligation to provide for maintenance and that a Homeowners Association is to be established. Other conditions regarding stormwater have been satisfied.
