DESCRIPTION/BACKGROUND:

The applicant requests a waiver from the Marion County Land Development Code (LDC) to allow the existing residence and proposed accessory dwelling unit (tiny home) to remain connected to the existing private potable well rather than extending centralized water service.

 

LDC 6.14.2.B(1)(a) requires new and existing single or multi-family residential development in the urban or rural area to connect to a centralized water system with available capacity if a water line is within a connection distance of 400 feet times the total number of Equivalent Residential Connections (ERCs). LDC 6.14.2.B(1)(b)3. requires existing structures to connect when the property is further developed, increasing its total number of ERCs.

 

Additionally, LDC 6.14.2.A(3) states that when property is within connection distance to water, the water main shall be extended to the farthest property line by developer.

 

The applicant states that the existing well is adequate to serve both dwellings and that extending centralized water service would result in significant infrastructure costs. The Development Review Committee (DRC) considered the request on July 27, 2026 and voted to deny the waiver request without support to the Board of County Commissioners.
