DESCRIPTION/BACKGROUND:

Section 2.16.1.B(8)(g) of the Land Development Code states a County Municipal Service Benefit Unit (MSBU) shall be established for the maintenance of the improvements created by this division prior to final approval and recordation. A waiver to this provision may only be granted by the Board upon review and recommendation by the DRC. The applicant’s statement of justification for the requested waiver is as follows:

 

The applicant requests waiver to allow an Easement Agreement that stipulates maintenance. This agricultural lot split is located in the northwest portion of the County and contains five (5) lots on 50.02 acres.

 

DRC action on September 13, 2021, by a vote of 5-0, was to accept the MSBU waiver conditioned on the applicant providing an acceptable alternative mechanism for maintenance via Homeowners Association (HOA) or Property Owners Association (POA) documents or an Easement Agreement to operate and maintain the facility.
