DESCRIPTION/BACKGROUND:

The Applicant, Doug Iannarelli with Moorhead Engineering, requested a waiver from the Land Development Code (LDC) Section 6.8.6.K(2) B-Type buffer and LDC 6.6.8(K) (4) D-Type buffer. The request is to waive the buffer requirements for the eastern and southern boundaries. The subject property is heavily wooded and abuts a water retention area to the west and south as well as properties to the east with agricultural uses, which have B-1 and A-1 zoning. The water retention area to the south has M-1 zoning. The applicant’s proposed site plan indicates retaining a number of large trees and underbrush adjacent to the neighboring parcels, which the applicant suggests will provide a natural buffer without the need of additional landscaping and walls as required by the LDC. The subject property is located east of S. Hwy. 475 on SE Hwy. 484 on approximately 3.0 acres.

 

On September 15, 2025, the Development Review Committee (DRC) denied the Waiver Request with recommendation of approval for the Board of County Commissioners with the condition that the existing trees be maintained along the eastern and southern boundaries. The other recommended condition is that if the southern portion of the subject property is improved, the required buffers be installed.
