DESCRIPTION/BACKGROUND:

This is a request for approval of a Resolution by Petitioner Avonlea, LLC to vacate Conservation Easement E and Conservation Access Easement between Conservation Easement E and Conservation Easement D and Conservation Access Easement between Conservation Easement E and SE 101st Court Road, as recorded in Plat Book 10, Pages 195-203. Vacating Conservation Easement E will allow for construction of a driveway. Conservation Access Easement between Conservation Easement E and Conservation Easement D, as well as Conservation Access Easement between Conservation Easement E and SE 101st Court Road provides access to and between Conservation Easement E. Therefore, the Conservation Access Easements would no longer be necessary.

 

The Development Review Committee considered this request on July 8, 2024 and it was the committee’s recommendation that the petition be granted. The applicant is still required to permit construction activities, which include appropriate mitigation for impacts to floodplain, flood prone or wetland areas.

Motion to adopt a Resolution to vacate Conservation Easement E and Conservation Access Easement between Conservation Easement E and Conservation Easement D and Conservation Access Easement between Conservation Easement E and SE 101st Court Road, Avonlea Phase 1, as recorded in Plat Book 10, Pages 195-203 and to authorize the Chair and Clerk to execute the same.
