DESCRIPTION/BACKGROUND:

The Applicant, Tyler Counts with Clymer Farner Barley, Inc, requested a waiver to Land Development Code (LDC) Section 6.12.12(D) which states: at the discretion of the Development Review Committee, in lieu of construction along external streets, the developer may pay a sidewalk fee to the County in an amount necessary to complete construction. This amount shall be determined by the project engineer and approved by the County with payment required prior to final plan approval. The County may use these funds toward the construction of sidewalks throughout the County based on priorities established by the Board.

The Applicant requested to waive required sidewalks along the property frontage, which the Development Review Committee was also in agreement with. However, the applicant does not want to contribute to the sidewalk fund which the Development Review Committee was not in favor of.

The subject property is located in the northwest portion of the County on approximately 12.72 acres.

This waiver request was denied by the Development Review Committee (DRC) on August 4, 2025, on the basis of the applicant not willing to contribute to the sidewalk fund in lieu of construction.
