DESCRIPTION/BACKGROUND:

Section 2.16.1.B(8)(g) of the Land Development Code states a County MSBU shall be established for the maintenance of the improvements created by this division prior to final approval and recordation. A waiver to this provision may only be granted by the Board upon review and recommendation by the Development Review Committee (DRC).

 

This agricultural lot split is in the north portion of the County containing 20 lots and one (1) tract on approximately 794.13 acres.

 

The applicant requested to allow the existing ingress/egress easement in lieu of a MSBU.  DRC action on May 8, 2023 was to recommend approval.

Recommended action

Motion to approve the Agricultural Lot Split without the creation of a MSBU subject to providing the appropriate documentation that the property owners will provide maintenance.
