DESCRIPTION/BACKGROUND:

In accordance with Land Development Code section 6.14.2, developers (property owners) are required to connect to public utilities if the property being developed is within connection distance. For a single-family residence, the connection distance is 400 feet from the parcel’s closest corner to the public water main. In this case, the property owner has applied for a building permit on a parcel within the 400’ connection distance of public water main provided by Marion County Utilities (MCU), and is required to install the water main across the parcel’s frontage, ending at the farthest corner.

 

After Agreement WME-107-S was presented to the Board and approved on August 5, 2025, the supporting Exhibit 1 (map) was found to be graphically incorrect, as it incorrectly identified a Benefiting Lot that already had water service and would not be improved by the proposed work. To correct the error, that parcel (benefitting lot) has been removed from the Agreement and Exhibit 1, and the project’s total cost was reallocated among the remaining five (5) parcels to be served. This Amendment is necessary to formally remove the non-Benefiting parcel from the payback share obligation as recorded in the Official Records.

BUDGET/IMPACT:

Neutral; project cost is $37,610 and construction purchase order includes 10% contingency in accordance with the Procurement Manual.  Funding is from ZF448536-563102 with project code UTC000094.

 

RECOMMENDED ACTION:

Recommended action

Motion to approve and authorize the Chairman and Clerk to: repeal the originally approved WME-107-S; execute the Amended Water Main Extension Connection Agreement WME-107-S; and authorize staff to issue the purchase order for T&C Underground under 22P-146.
