DESCRIPTION/BACKGROUND:

The Sabana Reserve Final Plat was approved by the Development Review Committee on August 4, 2025. The Final Plat will be forwarded to County Administration for signature once the Subdivision Improvement Agreements with Bonds are approved by the Board of County Commissioners. Land Development Code Section 2.18.4.D states that a security, limited to an irrevocable letter of credit, bond, or other form approved by the County Attorney, shall be provided in the amount of 120% of the estimated cost of remaining improvements.

Sabana Reserve has been divided into three phases with a Subdivision Improvement Agreement and Surety Bond provided for each phase. Phasing was instituted by the applicant to allow completion and releases of bonds by phases.

The timing of amenities has also been included in the Subdivision Improvement Agreements but are not part of the Surety Bonds.  Instead, the applicant has identified that construction of the Amenities will commence prior to issuance of the fiftieth (50) certificate of occupancy (CO); and all Amenities shall be completed by the earlier of the date of issuance of the one hundredth (100) CO or the date that is five (5) years from the first CO.

This subdivision is located in the central portion of the County containing 202 lots, 5 tracts, and 1.17 miles of road on approximately 47.28 acres.

Recommended action

Motion to approve the attached Marion County Subdivision Improvement Agreements,  with Surety Bonds, including timing of the amenities, and to authorize the Chairman and Clerk to execute the same.
