DESCRIPTION/BACKGROUND:

The applicant requests a waiver from Land Development Code (LDC) section 6.8.6.K(2) which states: “B-Type buffer shall consist of a 20-foot-wide landscape strip with a buffer wall. The buffer shall contain at least two shade trees and three accent/ornamental trees for every 100 lineal feet or fractional part thereof. Shrubs and groundcovers, excluding turfgrass, shall comprise at least 50 percent of the required buffer.

The applicant requests a waiver from the required buffer wall installation along their western boundary. The applicant’s parcel is 39122-008-00. The adjacent property owners at parcel 39122-004-00, have indicated a preference to maintain the existing fence and utilize the enhanced landscape buffer in lieu of a buffer wall along the shared property line. The requested waiver applies only to the wall component of the required buffer. Staff supports the waiver request since the applicant provided a notarized letter from the adjacent property owners (included in agenda attachments) affirming their preference to keep the existing fence and not require a wall.

RECOMMENDED ACTION:

Recommended action

The Development Review Committee (DRC) heard the request on the July 27, 2026 meeting and voted to deny the waiver request with support for approval by the Board of County Commissioners. The DRC recommends the Board approve the requested waiver.
