DESCRIPTION/BACKGROUND:

Section 2.16.1.B(8)(g) of the Land Development Code (LDC) states a County Municipal Services Benefit Unit (MSBU) shall be established for the maintenance of the improvements created by this division prior to final approval and recordation. A waiver to this provision may only be granted by the Board upon review and recommendation by the Development Review Committee (DRC).

 

This Agricultural Lot Split is located in the north-central portion of Marion County and contains two lots. The LDC Section 2.16.1 allows 10 lots of 10 acres each for an Agricultural Lot Split.

 

The applicant requests a waiver from the County MSBU requirement. The proposed 60’x40’ driveway easement would require minimal maintenance by the benefiting landowners. The DRC reviewed the request on July 27, 2026 and recommended denial of the waiver, determining that the request did not satisfy the requirements of LDC Section 2.16.1.B(8)(g)
