SUBJECT:

Request for Board Discussion and Direction Regarding the Proposed Drainage Retention Area and Right-of-Way Exchange at West Highway 40 and Northwest 80th Avenue (Budget Impact - None)

INITIATOR:

DEPARTMENT:

Steven Cohoon, P.E., County Engineer

Office of the County Engineer

DESCRIPTION/BACKGROUND:

In 2021, Marion County acquired 2.85 acres at the northwest corner of West Highway 40 and Northwest 80th Avenue for a drainage retention area (DRA) associated with the Northwest/Southwest 80th Avenue intersection improvement project. The acquisition totaled approximately $3.02 million, including settlement costs. The DRA was subsequently designed, permitted, and incorporated into the roadway construction project.

After construction commenced, the adjoining property owner, 40 & 80th LLC, approached the County regarding a potential property exchange and relocation of the DRA to accommodate drainage from both the County roadway and the proposed development.  Considerations included potential long-term benefits such as transferring DRA maintenance and major repair obligations to the Developer, preserving future right-of-way needs, and reducing portions of remaining construction costs.

A draft agreement has been developed addressing the property exchange, drainage improvements, construction responsibilities, and maintenance obligations. The roadway contractor has indicated that the proposed modifications appear feasible, may generate cost savings, and are not anticipated to delay roadway completion beyond existing utility-related impacts that have recently occurred.

Additional review of the draft agreement is needed and no final agreement is being presented for approval.

BUDGET/IMPACT:

None

RECOMMENDED ACTION:

Request Board discussion and direct staff accordingly.
