DESCRIPTION/BACKGROUND:
On behalf of the Office of the County Engineer, Procurement advertised a solicitation seeking bids from experienced and qualified contractors to mow 239 miles across the county during five cycles a year. The work consists of routine mowing of drainage retention areas, drainage right-of-ways, adjacent road right-of-ways, and conveyance swales within drainage easements where identified. In addition, this may also include trimming around structures such as pipe ends, discharge structures, trees, and fence lines. Seven (7) submittals were received for Areas I at 88.4 acres and X at 150.4 acres. Per Section 2-244(i) of the Marion County Ordinance, when two (2) Marion County-based contractors submit identical bids, the contract is awarded by a coin toss to determine the recipient. For Area X, a coin toss was conducted between JCM Outdoor Services, LLC (JCM) and Three Ponds Rental LLC, with more than ten witnesses present. JCM won the toss and was awarded the contract. Steven Cohoon, P.E., County Engineer, recommends contracting with Top Quality Lawn Maintenance, LLC and JCM, as the most responsive and responsible bidders.

BUDGET/IMPACT:
Neutral; estimated annual expenditure of $71,000, however this estimate may vary on the actual needs of service. Annual expenditures shall not exceed approved Fiscal Year budget amounts and shall be based on contracted acreage unit pricing without being brought back to the board. Funding is available in line EK430538-534101 - Stormwater Program.

Recommended action
Motion to approve the recommendation and allow staff to issue the contracts, and upon approval by Legal, authorize the Chairman and Clerk to execute the contract with Top Quality Lawn Maintenance, LLC and JCM Outdoor Services LLC under 25B-069.
