DESCRIPTION/BACKGROUND:
The 2020 Amended and Restated Access Management and Development Agreement was recorded in OR Book 7309, Pages 347-384, for the Freedom Crossings development. That agreement required preparation of a Traffic Impact Analysis (TIA) for each tract or phase prior to development approvals but did not address whether a plat could be recorded before the applicable TIA was completed.
The First Amendment clarifies this sequencing by allowing the Owners to record the plat for the commercial tracts and begin limited site development activity before completion of the TIA and construction of any required transportation improvements. Certificates of occupancy will be withheld until the TIA is completed and all concurrency improvements have been constructed to the satisfaction of the County.
This amendment provides flexibility to allow early commercial development while preserving all concurrency and access management provisions established under the existing agreement.
