DESCRIPTION/BACKGROUND:

A 2014 Developer's Agreement, recorded in OR Book 6144, Page 300, between Marion County and the Ocala Crossings South, LLC developer, allowed the developer to oversize County stormwater facilities to serve both the County and their development.

 

Upon execution of the agreement presented today, the developer will expand a drainage retention area adjacent to SW 49th Avenue, resulting in their use of 47.6% of the facility’s volume. Marion County will not be responsible for future maintenance and will only be responsible to contribute 52.4% of major maintenance or catastrophic repairs. This expanded area will be deeded to the County as identified in Exhibit C of the agreement, and in conjunction, an easement will be provided to the Developer for use of the stormwater facility and to perform maintenance activities.

Recommended action

Motion to approve the Agreement to Use County Stormwater Facility and authorize the Chairman and Clerk to execute said Agreement as well as the Deed and Grant of Drainage Easement included as Exhibit C.
