DESCRIPTION/BACKGROUND:
Paolo Mastroserio, P.E., Mastroserio Engineering, Inc., on behalf of North Pointe Mobile Homes Sales, LLC, filed an application for a Small-Scale Comprehensive Plan Amendment for a Future Land Use Designation Change from Commercial (COM) to Employment Center (EC). The Property Identification Number(s) associated with the property is 3564-032-000, the street address is 7265 SW Hwy 200, Ocala, on Lot 32 in the Green Turf Acres Unrecorded Subdivision. The subject property is in the Urban Growth Boundary (UGB), in the Silver Springs Secondary Springs Protection Overlay Zone (SSPOZ), and in Marion County Utilities’ Southwest Utilities Service Area, but is not within the Farmland Preservation Area (FPA). A concurrent Rezoning Application (Case Number 250110ZC) has also been filed for this subject property, and that Rezoning Application is dependent upon approval of this Amendment Application.
The site is the subject of two Code Enforcement Cases for improper display/sales of manufactured homes on the site and installation of manufactured homes without proper building permits. The cases are currently active, and power to the placed manufactured homes has been pulled at the direction of the Building Safety Director, and the status of the cases is pending the outcome of this Amendment Application and the concurrent Rezoning Application. Additionally, a site to the west is the subject of a comparable parallel Small-Scale Amendment Application and concurrent Rezoning Application, similar to this site (25-S01 and 250109ZC, respectively).
No letters of opposition or support have been received to date; staff notes that parties in opposition to the request appeared and spoke at the Planning & Zoning Commission public hearing held on December 30, 2024.
Staff recommends DENIAL of the request because it is not consistent with Land Development Code Section 2.3.3.B, which requires amendments comply and be consistent with the Marion County Comprehensive Plan as well as the provisions of Chapter 163, Florida Statutes, be compatible with the surrounding uses, and not adversely affect the public interest.
