DESCRIPTION/BACKGROUND:
James W. Gooding, III, Esq. filed a rezoning application on behalf of NW 49th Street Gateway, LLC., to change a ±105-acre site from General Agriculture (A-1) and Planned Unit Development (PUD, 190306ZP, expired) to Planned Unit Development (PUD). The Parcel Identification Numbers for the property are 13538-000-00 and 13539-001-00; with addresses of 5500 and 5110 NW 44th Avenue, Ocala, FL 34482, respectively. The site forms the NW corner of the NW 44th Avenue and NW 49th Street intersection, extending ± 0.45-mile to the north along the west side of NW 44th Avenue and ±0.50-mile to the west along the north side of NW 49th Street. The Golden Meadow Farms Subdivision lies ±300-foot to the north of the site’s northeastern area along NW 44th Avenue, while the Fountains Subdivision lies southeast along NW 44th Avenue. The site is in the Urban Growth Boundary (UGB), in the Silver Springs Secondary Springs Protection Zone (S-SPOZ), and in Marion County's NW Utility Service Area, but not in the Farmland Preservation Area (FPA). Staff note the subject site, and the lands to the south and west are part of the Northwest Gateway Community Plan (NGCP) study area. The NGCP has commenced with the study area’s initial design charette completed during the week of October 5, 2026.
A concurrent small-scale comprehensive plan amendment application (26-S07) to change the northeast part of the site’s future land use designation from Low Residential (LR) to Employment Center (EC) has also been submitted; this rezoning application is dependent upon an affirmative outcome of that concurrent amendment application, which is recommended for approval by staff.
Staff is recommending approval with conditions, wherein a key condition is the final PUD Master Plan or a subsequent development plan(s) to be considered by the Board in a public hearing prior to proceeding to development, including providing finished details regarding the Master Plan or the individual components. County staff and the applicant are further discussing the potential for concurrency certification and capacity reservations for the project. Staff have concerns related to the Traffic Impact Analysis’ (TIA’s) 2035 buildout date and the ordinary 5-year expiration date appliable to PUDs should the project’s development be delayed beyond the TIA’s 2035 buildout date. Staff will bring forward the results of those discussions with the consideration of this request.
