DESCRIPTION/BACKGROUND:

Brian Lamb of Inframark, LLC, filed a petition on behalf of Ocala SW 100th, LLC., to establish a new community development district (CDD) for a development to be titled Canterwood Acres pursuant to F.S. Section 190.005 and Marion County’s Code of Ordinances (COO) Chapter 14.5, Article III, Division 1.  COO Sections 14.5-43 and -44 require a draft petition to be considered in a “counseling phase” followed by the formal petition in a “formal filing phase.” The consideration of a CDD petition provides for staff review and a potential Board workshop to allow for Board discussion and questions.

 

Staff notes the Canterwood Acres CDD will consist of the “pair” of Ocala SW 100th LLC’s approved Planned Unit Developments now identified as Canterwood Acres West (PUD 211008Z for 222 detached single-family residential units) and Canterwood Acres East (PUD 211009Z for 180 detached single-family residential units) that lay along the south side of SW 100th Street and the Meadow Glenn Subdivision, between SW 49th Avenue and SW 62nd Avenue Road, adjoining the Cherrywood Estates, Alejandria Estates, Woods & Meadows East, Emerald Point, Sandy Pines, and Churchill Farms Subdivisions. As part of each PUD’s approval, the developer is responsible for the construction of SW 100th Street between SW 49th Avenue and SW 62nd Avenue Road; and construction of the roadway and each PUD is currently underway in accordance with each PUD’s respective final PUD Master Plan and subsequent development plan applications approvals.

 

The petition has been reviewed by the Marion County Property Appraiser and the County’s departments regarding infrastructure (e.g., central water, central sewer, roads, stormwater, etc.). Staff are requesting clarification related to some petition information, but do not have any significant objections to the request.  As acknowledged with prior CDD petitions, Marion County Utilities (MCU) does note that water and sewer improvements, once construction is complete, must be conveyed to MCU consistent with applicable County Ordinances, rather than being held by the resulting CDD.

 

Staff recommends foregoing a workshop and scheduling a public hearing date to consider the ordinance establishing the Canterwood Acres CDD on Tuesday, December 2, 2025, at 10:00 a.m., or soon thereafter, in the McPherson Governmental Campus Auditorium The petitioner will be responsible for placement and funding of the necessary public notice advertising (4 consecutive weekly ads) in a qualified newspaper of general circulation pursuant to Chapter 50, F.S., for the hearing.

Motion to: 1) elect to decline holding a workshop regarding the proposed Canterwood Acres Community Development District, and 2) schedule and authorize advertising (at the petitioner’s expense) a public hearing to consider an ordinance to establish the Canterwood Acres Community Development District on Tuesday, December 2, 2025, at 10:00 a.m., or soon thereafter, in the McPherson Governmental Campus Auditorium.
