DESCRIPTION/BACKGROUND:

The Florida Governmental Utility Authority (FGUA) previously completed a utility project within the Chatmire subdivision. During that project, ownership issues involving placement of FGUA facilities were identified and resolved through FGUA's acquisition of the affected property interests from the adjacent property owner. Through internal meetings, FGUA subsequently agreed to convey those property interests to Marion County, as the County requires ownership of the property interest to complete the Chatmire Roadway Improvement and Remediation Project, for which the Board of County Commissioners approved Bid No. 26B-056 on May 19, 2026.

 

As part of the conveyance of the roadway property interests from FGUA to Marion County, the County will grant FGUA a perpetual Utility Easement over the same roadway property being conveyed. The easement preserves FGUA's right to construct, operate, inspect, maintain, repair, replace, and access FGUA infrastructure located within those property interest after ownership transfers to the County.

 

Approval of the Utility Easement completes the County's portion of the conveyance documents requested by FGUA. Once executed by the Board of County Commissioners, the conveyance documents will be presented to the FGUA Board for approval and execution. Upon approval at its August 20, 2026 meeting, the FGUA Board will execute documents conveying the roadway property interests to Marion County. Upon recording of the executed easement and deeds, the property transfer will be complete, allowing Marion County to proceed with the Chatmire Roadway Improvement and Remediation Project.
