DESCRIPTION/BACKGROUND:
The attached interlocal agreement was developed at the request of the City of Dunnellon and on behalf of the Marion County Airport (Airport) after it was determined that portions of the Airport’s “airport hazard area” extend into the municipal boundaries of the City of Dunnellon, as illustrated on the attached map as overlap area.
State law (Section 333.03, Florida Statutes) requires the County and City to either establish a Joint Airport Zoning Board or enter into an Interlocal Agreement to ensure consistent implementation and enforcement of applicable regulations. After a legal review by the County and City, it was determined that an Interlocal Agreement was the best option for satisfying these requirements. Under the agreement, each party retains responsibility for administering and enforcing airport zoning regulations within its respective jurisdiction, while also establishing a process for intergovernmental review of development proposals within designated airport hazard areas.
The attached Interlocal Agreement, signed by the City, ensures compliance with state statutory requirements by formalizing coordination between the County and the City; supports continued protection of the Airport from incompatible land uses or obstructions; and promotes coordinated development review between the County and the City.
