DESCRIPTION/BACKGROUND:

Marion County is a party in a lawsuit regarding the opioid crisis. The Board of County Commissioners previously approved the Florida Subdivision Participation Agreements with the State of Florida regarding the National Distributor Settlement, the National Janssen Settlement and the Endo Settlement of claims related to the distribution of opioids. Under the Memorandum of Understanding with the State of Florida, attached hereto as Exhibit A, in order for the County to be considered a “Qualified County”, be entitled to receive its share of the regional funds, and to have direct control over its allocation, rather than funds being distributed to a managing entity, the County must adopt an abatement plan and enter into an agreement with the City of Ocala relating to the expenditure of opioid funds.

On March 1, 2022 the BCC approved the Interlocal agreement for the expenditure of Opioid Settlement Funds with the City of Ocala.  Per the agreement a joint Opioid Settlement Fund Administration Committee has been established to make recommendations for the expenditure of Regional Opioid Settlement funds to the Board of County Commissioners.

The committee recommended amending the Interlocal agreement between the City and County to allow a third party to assist with administering the Regional Opioid Settlement Plan. A separate agreement for a third party will be forthcoming to a future BCC meeting.
