DESCRIPTION/BACKGROUND:
Paolo Mastroserio, P.E., Mastroserio Engineering, Inc., on behalf of North Pointe Mobile Homes Sales, LLC, filed a Rezoning Application to change from Community Business (B-2) to Regional Business (B-4). The Property Identification Number(s) associated with the property is 3564-032-000, the street address is 7265 SW Hwy 200, Ocala, on Lot 32 in the Green Turf Acres Unrecorded Subdivision. The subject property is in the Urban Growth Boundary (UGB), in the Silver Springs Secondary Springs Protection Overlay Zone (SSPOZ), and in Marion County Utilities’ Southwest Utilities Service Area, but is not within the Farmland Preservation Area (FPA). A concurrent Small-Scale Comprehensive Plan Amendment Application (Case Number 25-S02) has also been filed for this subject property, and this Rezoning Application is dependent upon approval of the approval of that concurrent Amendment Application; however, staff recommends DENIAL of that concurrent Amendment Application.
During the January 13, 2025 Board meeting, the applicant requested that this item be continued. The Board agreed to consider this item during their March 17, 2025 Planning and Zoning Public Hearing.
The site is the subject of two Code Enforcement Cases for improper display/sales of manufactured homes on the site and installation of manufactured homes without proper building permits. The cases are currently active, and power to the placed manufactured homes has been pulled at the direction of the Building Safety Director, and the status of the cases is pending the outcome of this Amendment Application and the concurrent Rezoning Application.
No letters of opposition or support have been received to date; however, members of the public including neighboring property owners spoke in opposition to the request.
Staff recommends DENIAL of the rezoning application. Staff finds the requested zoning does not conform to LDC Section 2.7.3.E(2) would adversely affect the public interest, is not compatible with the Marion County Comprehensive Plan, and is not compatible with the surrounding area. On motion by Commissioner Behar, second by Commissioner Bonner, to agree with the staff findings and recommendation, the Planning and Zoning Commission voted unanimously (7-0) to recommend DENIAL of this request.
