DESCRIPTION/BACKGROUND:

Todd Rudnianyn, Manager, for Highway 27 West, LLC., has filed a Rezoning Application for a Planned Unit Development (PUD) Amendment for the Longleaf Park PUD (fka Quail Preserve PUD) on 11.31 acres of 18.98 acres. The Property Identification Number is 21602-000-00, no street address assigned; however, the site is located in the 5200 Block of N. US Hwy 27 immediately west of the Quail Meadow Subdivision. The subject property’s future land use designation is High Residential (HR) and Commercial (COM) and the site is within the Urban Growth Boundary (UGB) and Silver Springs Primary Springs Protection Overlay Zone (PSPOZ), but not within the Farmland Preservation Area. The purpose of the PUD Amendment is to amend the existing PUD approval to enable connection to City of Ocala Utilities central water and central sewer services, as a change in character to the project. On November 25, 2024, the Planning and Zoning Commission continued consideration of this request to December 30, 2024, at the request of the applicant to enable the applicant to further discuss the request with County staff, particularly Marion County Utilities staff.

Staff notes no change in the PUD’s residential intensity and/or development standards are proposed and the PUD will remain consistent with the surrounding uses. However, staff recommends DENIAL of the PUD Amendment as it is inconsistent with the Marion County Comprehensive Plan, and adverse to the public interest, as specified in the Sections IV.B. and C. of the attached Staff Report; further, staff has summarized potential outcomes of this PUD Amendment request, subject to final consideration by the Board of County Commissioners, in order to address compliance with the requirements in LDC Sections 1.4.2 and 2.7.3.

At the December 30, 2024 Planning and Zoning Commission public hearing, the applicant’s attorney proposed a new/additional PUD Development Condition regarding the request; county staff is evaluating the proposal and will provide its review as part of the Board presentation regarding this item. The Planning and Zoning Commission voted 5 - 2 to disagree with staff’s findings and recommend APPROVAL.  The motion did not include a recommendation to include the new/additional condition #7 as proposed by the applicant’s attorney, but it was understood that conversations with Marion County Utilities staff would be ongoing.
