DESCRIPTION/BACKGROUND:
James W. Gooding, III, Esq. filed a Small-Scale Comprehensive Plan Amendment Application (Amendment) on behalf of NW 49th Street Gateway, LLC, to change the future land use designation for a ±31.44-acre parcel from Low Residential (LR) to Employment Center (EC) on the west side of NW 44th Avenue ±1/4 mile north of NW 49th Street. The Parcel Identification Number for the property is 13538-000-00; the address is 5500 NW 44th Avenue, Ocala, FL 34482. The site is in the Urban Growth Boundary (UGB), the Secondary Springs Protection Overlay Zone (S-SPOZ), and Marion County's NW Utility Service Area, but not in the Farmland Preservation Area (FPA). The parcel does not include any FEMA Flood Zone Areas or Marion County Flood Prone Areas. Staff note the subject site, and the lands to the south and west are part of the Northwest Gateway Community Plan (NGCP) study area. The NGCP has commenced with the study area’s initial design charrette completed during the week of October 5, 2026.
A concurrent rezoning application to change the site's zoning from General Agriculture (A-1) to Planned Unit Development (PUD) has also been submitted (261010ZP). That concurrent zoning application is dependent upon the granting of this amendment application. Should this application not be approved, that PUD application will not be eligible for approval as currently proposed. Further, that PUD application proposes a reduced maximum development amount for the overall combined site, which is reflected in the staff analysis given the concurrent status of the two applications.
Staff recommended approval, and the Planning & Zoning Commission agreed with staff’s findings and recommendation and voted to recommend approval, 5-0.
