DESCRIPTION/BACKGROUND:

Ms. Victoria Billig serves as an advisory board member on the Tourist Development Council.  She is the Assistant Director for Appleton Museum of Art and also works as an independent contractor for Maven Photo and Film.  Both entities receive funds from Marion County.  Chapter 112, Part III, Florida Statutes, establishes ethical standards of conduct and governs conflicts of interest for elected and appointed public officers.  The purpose of this agenda item is to provide a waiver of potential ethical conflict for Ms. Billig, as she may hold a conflicting employment, contractual or other relationship with an outside business entity, which is prohibited by Section 112.313(3) and (7), Florida Statutes, absent a waiver as permitted by Section 112.313(12), Florida Statutes. 

Section 112.313, Florida Statutes, states that the requirements of Section 112.313(3) and (7) may be waived by the body appointing the person with the conflict to an advisory board, upon full disclosure of the relationship constituting the conflict and affirmative vote in favor of waiver by a two-thirds majority.  The waiver, if granted, would permit Ms. Billig to continue her role with both of the outside business entities while also serving as an advisory board member of the Tourist Development Council. Even if a waiver is granted, should the Tourist Development Council have an agenda item concerning Appleton Museum or Maven Photo and Film, Ms. Billig would still have to declare a voting conflict and fill out the required forms. Accordingly, a waiver under Section 112.313(12), Florida Statutes, is requested for Victoria Billig.
