SUBJECT:

Request for Board Discussion and Direction Regarding the Proposed Amendment to the Freedom Crossings Amended and Restated Access Management and Development Agreement (Budget Impact - None)

INITIATOR:

DEPARTMENT:

Steven Cohoon, P.E., County Engineer

Office of the County Engineer

DESCRIPTION/BACKGROUND:

On or about February 17, 2009, Marion County entered into an Access Management and Development Agreement with the Freedom Crossings property owners establishing the locations and permitted turning movements for access along Southwest 60th Avenue and Southwest 95th Street.

On November 3, 2020, the County approved an Amended and Restated Access Management and Development Agreement, which updated and replaced the original Agreement while maintaining the established access configurations.

The existing Agreement identifies Future Entrance B on Southwest 60th Avenue as a right-in/right-out access. However, the County constructed the intersection with an additional southbound left-turn movement. The property owners have requested an amendment to recognize the existing configuration and establish an additional right-in-only access connection along Southwest 60th Avenue, identified as Future Entrance D.

During general public comment at the October 6, 2026, Board meeting, representatives of the property owners requested that the proposed amendment be brought before the Board for consideration. The Board directed staff to return with the matter for discussion at its October 21, 2026 meeting.

Following coordination with the County Attorney's Office and Growth Services, staff has been advised that formal consideration and approval of the amendment requires two (2) publicly noticed meetings pursuant to Chapter 163, Florida Statutes.

This item is being presented for Board discussion and direction regarding the proposed access modifications and whether to proceed with the required public meeting process for formal consideration of an amendment.

BUDGET/IMPACT:

None

RECOMMENDED ACTION:

Request Board discussion and direct staff accordingly.
