DESCRIPTION/BACKGROUND:
Victoria Diaz with Bowman Engineering, Inc., on behalf of Sumter Electric Cooperative, Inc. (SECO Energy), filed a Rezoning Application to change the zoning for a ±39.2 acre property from General Agriculture (A-1) to Community Business (B-2). The Property Identification Number(s) associated with the property is 41200-012-00, the street address is 12644 SW 16th Avenue (CR Hwy 475A). The subject property is outside the Urban Growth Boundary (UGB) and the Farmland Preservation Area (FPA) but within the Marion Oaks/I-75/Hwy 484 Urban Area, in the Silver Springs Secondary Springs Protection Overlay Zone (SSPOZ), in Marion County Utilities’ Southwest Utilities Service Area, and in the CR 475A Visual Enhancement Gateway Development Overlay (CR 475A Overlay). A concurrent Special Use Permit Application (Case No. 250204SU) has also been filed for this subject property and two adjoining properties to the south, and that Special Use Permit Application is dependent upon approval of this Rezoning Application; however, staff recommends DENIAL of that concurrent Special Use Permit Application.
Letters of opposition and support have been received regarding the request.
Staff recommends APPROVAL of the rezoning application. Staff finds the requested zoning does conform to LDC Section 2.7.3.E(2) as it would not adversely affect the public interest, is compatible with the Marion County Comprehensive Plan, and is compatible with the surrounding area; and is consistent with LDC Section 5.8.4 - Permitted Uses within the CR 475A Overlay.
At the request of the applicant, consideration of this request was continued by the Planning and Zoning Commission from January 27, 2025, to March 31, 2025, and then subsequently continued to May 28, 2025, also at the applicant’s request where on motion by Commissioner Lourenco, second by Commissioner Fisher, the Planning and Zoning Commission agreed with staff's findings and recommendation and voted (6-0) to recommend approval of the Application.
