DESCRIPTION/BACKGROUND:

Kimley-Horn and Associates, Inc., on behalf of property owners, Lake Louise, LLC., has filed an application to rezone a 9.51-acre parcel on the north side of SW32nd St. from Single-Family Dwelling (R-1) to Planned Unit Development (PUD) for a maximum of 151 multi-family dwelling units, pursuant to the provisions of Land Development Code (LDC) Division 2.7 - Zoning and LDC Section 4.2.31. The subject property is situated inside the Urban Growth Boundary (UGB) as well as the County's Primary Springs Protection Overlay Zone (P-SPOZ).

 

Robert Batsel with Gooding & Batsel, PLLC. stepped in as agent of this case at the Planning and Zoning public hearing. Following Planning and Zoning, Mr. Batsel has attempted to address the missing or incomplete items from the initial PUD submittal. Planning staff has concerns regarding timing of the project development as the Planned Development inside the City of Ocala does not have a buyer or developer, nor does it have a timetable for development. Planning staff has changed their recommendation of denial presented during Planning and Zoning to approval with conditions.  A specific condition has been added requiring the City portion of the project be developed first.

Staff recommends approval with conditions. Planning and Zoning Commission does not have a recommendation after a motion to deny failed (3 - 3 vote).
