DESCRIPTION/BACKGROUND:
The applicant requested a waiver to Land Development Code section 6.8.6.K(2) which states B-Type buffer shall consist of a 20-foot-wide landscape strip with a buffer wall. The buffer shall contain at least two shade trees and three accent/ornamental trees for every 100 lineal feet or fractional part thereof. Shrubs and groundcovers, excluding turfgrass, shall comprise at least 50 percent of the required buffer.
The applicant requests to install a 6-foot opaque vinyl fence instead of 6-foot masonry wall because the opaque fence will match the existing opaque fence behind the Walmart Neighborhood Market, which abuts the subject property to the south. The proposed vinyl fence will run along the boundary that abuts the R-3 zoned lots 2 and 3 for approximately 1,050 linear feet (see Exhibit 1). The applicant also notes that Section 6.8.6.L(1) of the Land Development Code (LDC) allows substituting a buffer fence for a buffer wall.
This waiver request was heard by the Development Review Committee (DRC) on June 1, 2026. The DRC voted to deny the waiver request to allow the Board to decide whether to waive the wall. DRC does support the waiver, and recommends that should the Board approve the waiver, it be conditioned upon the applicant, or applicant’s heirs or assigns, maintaining the opaque vinyl fence and replace/repair any damaged or discolored sections within 60 days of notification.
