DESCRIPTION/BACKGROUND:

On January 30, 2024, Travis Aldana, as agent for Richard Bernasol, filed a small-scale land use amendment application with a companion rezoning application to change ±5.39 acres of a parcel from Public to Commercial future land use designation, and General Agriculture (A-1) to Heavy Business (B-5) zoning classification (see Attachment F for the original zoning change application). The Parcel Identification Number (PID) for the overall property is 41489-000-00 and it is located on CR 484, east of I-75; no address has been assigned to the property. 

 

On April 17, 2024, the Board of County Commissioners (Board) considered the above applications, and approved the land use amendment, changing the future land use designation to Commercial. However, the Board denied the request to rezone to Heavy Business (B-5). Instead, the Board approved a lesser intense zoning change to Community Business (B-2), while extending an invitation to the applicant to return with a Special Use Permit application, and offered to waive the application fee for same. In response to the Board's direction, on April 25, 2024, the applicant applied for a special use permit to allow for commercial development of an enclosed storage warehouse on the subject site, now zoned B-2 (Community Business). The site is located outside of the Urban Growth Boundary (UGB), but inside the Silver Springs Secondary Springs Protection Zone (SSPZ), and Marion County Utility services to this site are currently unavailable. 

 

Staff recommends approval of the Special Use Permit request subject to a series of development conditions as provided within the staff report.
