DESCRIPTION/BACKGROUND:
On July 27, 2021, the County Attorney received a request from Anthony J. Young, requesting a release of the Civil Restitution Lien for $4,500.00, recorded in Official Records, Book 5533, Page 1972, on June 22, 2011. Mr. Young is requesting a release of the Civil Restitution Lien totaling $6,917.74 as of August 17, 2021; or, in lieu of a complete release of the lien and any interest, for the Board to accept payment of $4,500.00 in full satisfaction of the lien and any interest.
On February 5, 2011, Mr. Young was arrested for possession of marijuana (not more than 20 grams) in Case Number 2011-MM-1045. On April 7, 2011, he was adjudicated guilty and sentenced to 90 days in the Marion County Jail. The Court imposed a Judgment of Cost of Incarceration of $4,500.00 (sentence of 90 days x $50.00 per day) with interest to accrue at the legal rate. He served 85 days in jail. As of this date, no money has been paid towards the Civil Restitution Lien; however, Mr. Young has paid all other court costs in this case.
Mr. Young is a business owner in Daytona Beach and is requesting a release of the civil restitution lien as the debt is a hindrance to his future business and home ownership opportunities.
