DESCRIPTION/BACKGROUND:

James Hartley, with Gooding & Batsel, and on behalf of the property owner, Moser Family Trust c/o Gary Moser, has applied to rezone a 9.05-acre property located at 4480 SE 120th Street from General Agriculture (A-1) to Residential Estate (R-E). This request is made pursuant to the provisions of Land Development Code (LDC) Division 2.7 - Zoning and LDC Section 4.2.8 - Residential Estate (R-E) Classification. The stated intent is to execute a one-time division to create one additional parcel for one additional residential dwelling unit. This type of division is permissible per LDC Sec. 2.16.1.B.

 

The subject property has not been platted but was divided previously as a family division. It is located within the Urban Growth Boundary and has a Low Residential (LR) Future Land Use designation which allows a density of 0-to-1 dwelling unit per acre. Additionally, the property is located within the County's Secondary Springs Protection Overlay Zone (S-SPOZ). There are no concurrent applications associated with this rezoning request, nor are there any code enforcement cases related to the subject property.
