DESCRIPTION/BACKGROUND:

Harvey Cohen, the registered agent and title manager for the property owner, 520 NE 82nd Terrace LLC, applied to rezone a 0.86-acre parcel and 6.79-acre parcel (combined 7.65-acre site). The subject site is located approximately 0.2 miles north of the intersection of SE Hwy 42 and S Hwy 475. The request proposes to rezone the subject site from Heavy Business (B-5), Regional Business (B-4) and General Agriculture (A-1) to Rural Activity Center (RAC) in accordance with Land Development Code (LDC) Division 2.7. The site lies within the Secondary Springs Protection Overlay Zone (SSPOZ) and outside of the Urban Growth Boundary (UGB) and Farmland Preservation Area.
