Body
DESCRIPTION/BACKGROUND:
James T. Hartley, on behalf of Skyway Towers LLC, has filed an application for a special use permit to allow for a new 195’ telecommunication tower, on property owned by the Overcash-Evans Family Trust. The Property Identification Number associated with the property is 45794-000-00, the site address is 11411 SE 132nd PL., Ocklawaha, FL, 32179, and the legal description is displayed on the deed included as part of the application. The subject property is located within the Secondary Springs Protection Overlay Zone (S-SPOZ) and is outside of the Urban Growth Boundary (UGB).
This request was originally submitted for consideration during the July case cycle; however, the applicant requested a continuance to allow additional time to obtain the required documentation. Section 4.3.25(B)(1)(e) - Location Priority - of the Land Development Code provides that, to the extent possible, telecommunications towers shall be located in accordance with the established prioritization of facilities and sites. Properties controlled and used by a governmental or quasi-governmental entity are given priority over new tower construction on other properties. Additionally, when a proposed tower site is adjacent to property owned by a governmental entity, the applicant must provide a letter from the governmental entity confirming that it has no interest in having the tower located on its property. The subject parcel is adjacent to two (2) Government-owned properties, namely: Carney Island Recreation and Conservation Area to the south and Davis Landfill to the north. The applicant obtained the required letter from Marion County regarding the Carney Island property. However, a response regarding the Davis Landfill could not be obtained within the applicable timeframe. Accordingly, the applicant requested a continuance to allow additional time to obtain a response regarding the Davis Landfill property.
Marion County Solid Waste, through Marion County Property Management, has indicated that it is receptive to the placement of the tower on the Davis Landfill. However, the applicant has elected to pursue placement of the tower on the subject parcel instead.
