DESCRIPTION/BACKGROUND:
On September 4, 2024, the Marion County Board of County Commissioners approved the Resolution to Close and Abandon Roads and Convey All Dedicated Roads, Rights-of-Way, and Appurtenant Drainage Facilities within the Plat of Quail Meadow (Plat Book Y, Pages 89-91) to the Quail Meadow Property Owners Association, Inc. (Association), in accordance with Section 336.125, Florida Statutes. Upon conveyance, the Association assumed responsibility for maintenance, operation, and repair of the internal subdivision roadway and drainage system.
As a subsequent step to that action, the Association now intends to install entry gates and related turnaround improvements located partially within the County right-of-way at NW 49th Avenue and NW 30th Place to control access to the subdivision.
The County and the Association desire to enter into a Maintenance Agreement to formalize responsibilities for these improvements. Under this agreement, the Association shall install, operate, and maintain the gates, turnaround, and any associated improvements within the County right-of-way at its sole expense and liability. This Agreement shall remain in effect for as long as the gates and related facilities are in place.
