DESCRIPTION/BACKGROUND:

The Developer (95th Street Holdings, LLC) has agreed to construct Developer Improvements pursuant to the attached agreement in coordination with the development of the Pioneer Ranch Subdivision.  The improvements include an additional southbound left turn lane on SR 200 permitting traffic to turn east on to SW 95th Street Road, as well as optimizing the signal timing at this intersection.  Developer shall cause substantial completion of the developer improvements to occur within two (2) years after the effective date of this agreement.

This project is an identified Intelligent Transportation Systems (ITS) project within the Transportation Planning Organization’s 2045 Long Range Transportation Plan and with a super majority vote is eligible for Impact Fee Credits. The Developer requests such credits not expire for twenty (20) years from the effective date of the Agreement.

This project is estimated to cost $515,940, and while not specified in the Agreement, the Developer acknowledges by separate correspondence that they are only entitled to Impact Fee Credits not to exceed this amount, as per County Impact Fee Ordinance No. 15-14, Section 10-323(d)(2).
