DESCRIPTION/BACKGROUND:
This Agreement concerns future improvements of the intersection at SE Hwy 42 and SE 91st Phillips Court following development adjacent to the intersection.
The developer conducted a traffic analysis in September 2025 with a finding that the intersection did not warrant modification at that time. The County is requiring a follow-up traffic analysis. The proposed Agreement states that the developer must conduct a traffic study between 12 and 24 months following issuance of the final certificate of occupancy. Among other items, the decision to close the north bound left turn from SE 91st Phillips Court onto SE Hwy 42 and the through movements from SE 91st Phillips Court to SE 91st Court will be determined. If modifications are warranted, the developer shall design, permit, and construct the improvements at the developer’s expense.
The developer shall provide financial assurance that it has the means to cover intersection modifications prior to the issuance of the final certificate of occupancy.
