DESCRIPTION/BACKGROUND:

Land Development Code (LDC) section 2.16.1.B(8)(g) states a County Municipal Services Benefit Unit (MSBU) shall be established for the maintenance of the improvements created by this division of land prior to final approval and recordation. A waiver to this provision may only be granted by the Board upon review and recommendation by the Development Review Committee (DRC).

 

The applicant is requesting such waiver for the Watching Park Farms Agricultural Lot Split as the property is already subject to an existing homeowner’s association. Survey Note number 12 on the cover page of this Agricultural Lot Split states that “Marion County Board of County Commissioners shall have not duty or responsibility in the maintenance of the non-exclusive private roadway and utility easement as shown an described hereon.”

 

The Agricultural Lot Split is located in the southwestern portion of Marion County and consists of six (6) lots on approximately 168.82 acres. The parent parcels are 20909-028-00 and 20909-031-00. The LDC section 2.16.1 permits 10 lots of 10 acres each for an Agricultural Lot Split.

 

The Agricultural Lot Split and waiver to the MSBU requirement was reviewed by the Development Review Committee (DRC) on May 4, 2026. During review, questions were raised regarding the parent parcel configuration and apparent flag lot status. Those items have been reviewed by Marion County Legal and are being addressed as part of the Agricultural Lot Split approval process. These matters are separate from and do not affect the requested waiver from the requirement to establish a MSBU.
