DESCRIPTION/BACKGROUND:

The School Board has forwarded to Marion County its school impact fee study for consideration in conjunction with a proposed Marion County Educational System Impact Fee Ordinance in Marion County. The School Board staff and consultant have prepared the study upon which the school impact fees set forth in the Ordinance are predicated. There is a possibility of litigation which may challenge the validity and/or constitutionality of the Ordinance or its application to certain property. This agreement provides for the School Board to defend any such legal challenges and to reimburse the County for any liabilities ordered by a Court, and other related provisions. A copy of the Agreement is attached.
